This is true, but considering how high tech the methods have to be to get the video from the laptop I don't think you can rule out an ability to break into a phone.Since his new phone was a gift and not a straight replacement, I'd say he merely turned off the old phone, with no regard for "information hygiene." But it should still require a PIN or password or something upon turning back on (again I hope, maybe the smartphone is too old for that?).
Maybe everyone has teamed up to oppose the DIKs. B&R's own Sinister Six, or Secret Society, or another nerd term for villain groups
Right now I see five options for why the laptop and not the phone.
1. The spy is old school and knows how to break into a safe, but not a phone.
2. The Cathy Clucker installed spyware and the laptop is remotely accessible when connected to the net.
3. The spy made a copy of the video before Rusty put it back into the safe after it was used in the evaluation party.
4. The spy has in some way obtained the safe combination.
5. Tommy is the spy.

The guide is up-to-date for Episode 10 – Calm Before the Snow
Casiope's guide is hands down the best guide for the game, and I know many of you rely on it. The amount of effort and dedication he put into creating such an incredible guide is truly unmatched.
I asked around to see if anyone knew where he was, but sadly, I didn’t have any luck. With episode 10 out and no update in sight, I decided to take it upon myself to give it a shot.
I’ve done my best to maintain the high standard of his work, though I’ll admit, I’m not as talented as he is. Not every section has been updated, but here’s what I’ve worked on:
- Choices, conditions, and consequences for Episode 10
- Pack Quest #5
- Special Renders/2D Arts and Vault codes for Episode 10
- Added sections covering the new minigames
- Added cheating points
- Added new wallpaper gallery

It's quite possible. It's logical to assume that the target of the surveillance is Rusty.
And Tommy is the first person Rusty became close with upon arriving at B&R.
I still believe that Jill's father is behind all of this.
Perhaps B&R College has been a kind of hidden brothel for influential people since its inception.
And it's not surprising that Rusty was put under surveillance.
It's not known what his reaction will be if he finds out the truth. He needs to be taken under control.
To do this, they need to gather information that will allow them to blackmail him or his father.
Although it's possible that Rusty's father also uses the services of the brothel.

I have an idea that these leaks are the work of different groups with different goals.
Or maybe this video was hard to use at that time to hurt DIKs. After all, from that angle we only see Jade fucking a guy and we don't see his face (only Jade's hair in the frame gives her away).
Cathy cluck was the perfect bomb: a published pic with comments from the DIK account, the perfect setup. It's harder to use Jade leak here to target DIKs, but it's perfect to target Jade.

The Interlude was shorter than I remember, and I took a few breaks. It could still be streamlined, especially since the impetus for going to San Diego (surfing) is kicked to the curb rather fast. Definitely didn't need a lewd for Emma and Bret, but I guess people would complain about the lack of lewds, but also complain if Zoey fucked someone else, so this is the compromise. But all in all, it's not bad. Also it confirmed MC's old phone is off.

It depends on if they got their hands on the original video, because that does show MC's face.
But the evaluation version is cropped, you're right that it's harder to guess. It still has the audio though, you could recognize the voices.
