yes, non-con can be forced (ie, tomie can say 'no', but that sometimes fails, so she has sex anyway).
however, you can make non-con scenes virtually impossible to get by (1) setting your persuasion level to very easy in the settings (ie, tomie can deny sex requests very easily), (2) carrying an 'unbreakable bell', which is an emergency tool that tomie can use to get herself out of tricky situations, and (3) having very low corruption and submissiveness levels. low submissiveness practically means that tomie can deny sex requests more easily
it's hard to say how much of the game's content is non-con tbh, as that depends on how you play the game. for instance, you can play through the entire game and get endings with low corruption and submissiveness without getting 1 non-con scene or even 1 sex scene. anyway, it's important to remember that there are not a lot of exclusive non-con H-scenes: the vast majority of animations can be obtained through both consensual and non-con encounters
also, you can just use a full save and view the entire gallery, if you really don't want non-con encounters
